SmartestAppes ("us", "we", or "our") operates https://www.smartestappes.com and the KitchenAppes mobile application (collectively, the "Service"). This document includes our Terms of Service and Privacy Policy, describing your rights and obligations and how we collect and use Personal Information.
Terms of Service
Welcome to SmartestAppes and KitchenAppes! By accessing or using our mobile application, website, and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. By using the Service, you represent that you are at least 16 years old (or older if required by the laws of your place of residence) and capable of forming a binding contract, or that you are using the Service with the consent and supervision of a parent or legal guardian.
AI Transparency Disclosure: Whenever you see content marked or described as "AI-generated", or when you use features identified as AI-powered, you are interacting with artificial intelligence rather than human-curated content. AI features are experimental and may produce inaccurate, incomplete, or inappropriate results.
Use of the Service
You may use our Service only if you can form a binding contract with us, and only in compliance with these Terms and all applicable laws. When you create your SmartestAppes account, you must provide us with accurate and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Content
Our Service allows you to post content, including photos, recipes, text, messages, and comments. Anything that you post or otherwise make available on our Service is referred to as "User Content". You retain all rights in your User Content and are solely responsible for the User Content you post to SmartestAppes. By posting User Content, you represent and warrant that: (a) you own or control all rights in and to the User Content, or you have all necessary licenses, rights, consents, and permissions to use and share the User Content and to grant the license set out in these Terms; (b) your User Content does not infringe or violate any copyright, trademark, trade secret, moral right, privacy right, publicity right, or any other intellectual property or proprietary right of any third party; and (c) your User Content is not stolen, unlawful, or submitted in breach of any contractual obligations you have with third parties.
AI-Generated Content
AI-Generated Recipes and Content: Our Service uses artificial intelligence (AI) models to generate recipe suggestions, ingredient recommendations, and other content based on user inputs (such as your recipes, preferences, or photos). AI features are marked explicitly in the app. The content generated does not constitute nutritional, medical, or professional advice. Do not rely on it for cooking without independent verification, including allergens and food safety.
When you provide input to generate content, your data may be processed by AI systems, including third-party large language models (LLMs). When you input data (such as recipes, images, or preferences) into an AI feature, the data is processed temporarily by third-party LLMs acting as processors on our behalf, solely for generating that specific output. The data is not used for model training but is deleted immediately after processing. We require providers to use data processing agreements, anonymization, and Privacy-Enhancing Technologies (PETs) for protection. We implement appropriate technical measures to minimize data exposure, but you acknowledge that AI-generated content may contain inaccuracies, omissions, or unsuitable recommendations.
You are solely responsible for verifying the accuracy, safety, and suitability of any AI-generated recipes before use, including checking for allergies, dietary restrictions, and correct measurements. SmartestAppes is not liable for any harm, injury, or adverse effects resulting from AI-generated content. AI-generated content is provided for informational and entertainment purposes only and should not be relied upon as a substitute for professional culinary, nutritional, medical, or safety advice. You are solely responsible for evaluating the accuracy and suitability of any AI-generated recipes, including for allergies, intolerances, religious or ethical dietary requirements, health conditions, and safe food handling. To the extent permitted by applicable law, we disclaim all liability arising from your reliance on AI-generated content.
We may use third-party AI providers (such as large language models) to process your inputs and generate outputs, and such providers act as our processors or service providers under applicable law.
User Conduct and Prohibited Content
You agree not to upload, post, transmit, or otherwise make available through the Service any User Content or other material that: (a) is illegal, abusive, harassing, defamatory, obscene, pornographic, sexually explicit, or otherwise inappropriate; (b) contains hate speech, threats, incitement to violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic; (c) infringes or violates any intellectual property, privacy, publicity, or other rights of any person or entity; (d) includes personal data or confidential information of others without their authorization; (e) contains spam, unsolicited advertising, or other forms of unauthorized solicitation; or (f) contains viruses, malware, or other harmful code. We use technical and/or moderation tools designed to detect or block certain types of inappropriate content, but we do not guarantee that all such content will be prevented, detected, or removed. You understand that you may be exposed to content that you may find offensive or objectionable and agree that, to the fullest extent permitted by applicable law, we are not responsible for such content.
Data Sharing Between Users
The Service allows users to share User Content, messages, and other information with us and with other users. Other users may view, copy, save, screenshot, or re-share any User Content that you choose to make public or share with them. You are solely responsible for the information and content you choose to share on or through the Service. SmartestAppes is not responsible for any misuse, copying, distribution, or theft of your User Content by other users or third parties, nor for any damages arising from such actions, except where we are expressly required to be responsible under applicable law. Do not share any information or content through the Service that you would not want others to see, copy, or re-share.
Intellectual Property and Infringement
All rights, title, and interest in and to the Service (excluding User Content), including all software, text, graphics, logos, trademarks, service marks, and other materials, are and remain the exclusive property of SmartestAppes and its licensors. Nothing in these Terms grants you any right to use SmartestAppes' name or any of its trademarks, logos, domain names, or other distinctive brand features without our prior written consent. If you believe that any content on the Service infringes your copyright or other rights, please contact us at the email provided in the CONTACT section with: (a) a description of the content you claim is infringing; (b) the URL or location of the content within the Service; and (c) information demonstrating your ownership of the rights or your authorization to act on behalf of the owner. We may remove or disable access to any content that is alleged to be infringing and may terminate accounts of repeat infringers, in accordance with applicable law.
Disclaimers
The Service and all content (including User Content) are provided on an "AS IS" and "AS AVAILABLE" basis. SmartestAppes makes no representations or warranties of any kind, whether express, implied, or statutory, as to the operation of the Service or the information, content, or materials included therein, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. Any content accessed through the Service is accessed at your own discretion and risk.
Limitation of Liability
To the fullest extent permitted by applicable law, SmartestAppes and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to: (a) your access to or use of, or inability to access or use, the Service; (b) any conduct or content of any user or third party on or through the Service, including any unauthorized access to or use of your content or data; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content. Where applicable law does not permit us to limit liability for the use of artificial intelligence in this way, these limitations shall apply only to the fullest extent permitted, and nothing in these Terms prevents you from exercising any non-waivable consumer rights under such laws. In no event shall SmartestAppes' total liability for all claims relating to the Service exceed the greater of (i) the amounts you have paid to SmartestAppes, if any, for use of the Service in the twelve (12) months immediately preceding the claim, or (ii) 50 USD (or equivalent). Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for willful misconduct.
Termination
We may terminate or suspend your right to access or use the Service for any reason on appropriate notice. We may terminate or suspend your access immediately and without notice if we have a good reason, including any violation of these Terms or applicable law. We may remove or block access to any User Content at any time if we reasonably believe it violates these Terms or the rights of others, or to protect other users or the Service. Upon termination, your right to use the Service will immediately cease, but any provisions of these Terms that by their nature should survive termination (including User Content license, disclaimers, limitation of liability, and governing law) will continue to apply.
Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or with the Service (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law rules. You agree that the courts of Tel Aviv-Yafo, Israel, shall have exclusive jurisdiction to settle any such dispute or claim, and you irrevocably submit to the exclusive jurisdiction of such courts. However, you may also have additional mandatory rights or remedies under the laws of your country of residence, and nothing in these Terms limits any such rights to the extent they cannot be limited by contract.
Privacy Policy
This Privacy Policy describes how SmartestAppes collects, uses, and discloses Personal Information when you use the Service, and the choices you have associated with that information. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy and applicable laws.
AI and Automated Processing: We use automated systems and artificial intelligence to process certain Personal Information (such as your recipes, preferences, and interaction history) to suggest recipes and ingredients, personalize your experience, and improve the Service. Temporary AI Processing: Data input for recipe generation may be sent temporarily to third-party LLM providers (such as generative models) as processors, but solely for producing the specific output. No use for training or long-term storage. Legal basis: contract performance (service provision) and legitimate interests (service improvement), with safeguards per PPA guidelines. For users in the EU/EEA and UK, such processing is based on (i) performance of our contract with you where necessary to provide the Service, and (ii) our legitimate interests in improving and securing the Service, except where your interests or fundamental rights and freedoms override those interests. Where required by law, we will obtain your consent before using AI for certain forms of profiling or personalized advertising. Where we use AI or other automated means to process Personal Information for personalization or profiling, you may have the right to: object to such processing; request human review of certain decisions that significantly affect you, where applicable; and obtain meaningful information about the logic involved, subject to trade-secret and security limitations.
Information Collection And Use
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your name, email address, profile information, and any content you choose to submit through the Service ("Personal Information"). We may also collect information that you voluntarily provide when you contact us, participate in surveys, or interact with other users.
We use your Personal Information only for providing and improving the Service. This includes: operating and maintaining the Service; enabling user registration and account management; allowing you to create, share, and interact with User Content; personalizing your experience; understanding how the Service is used; communicating with you, including responding to your inquiries and sending important notices; protecting the security and integrity of the Service; and complying with legal obligations.
Legal Bases and Data Subject Rights (EU/EEA/UK)
If you are located in the EU/EEA or UK, we only process your Personal Information where we have a legal basis to do so. Legal bases include: (a) your consent (for example, for certain cookies or marketing communications); (b) performance of a contract (for example, to provide the Service to you); (c) compliance with a legal obligation; and (d) our legitimate interests (for example, to maintain and improve the Service, prevent abuse, and protect our legal rights), provided that such interests are not overridden by your data-protection interests or fundamental rights and freedoms. You have certain rights under data protection laws, including the right to access, correct, delete, and restrict certain processing of your Personal Information, as well as the right to object to certain processing and to data portability. You also have the right to lodge a complaint with a supervisory authority in your country of residence or place of work.
Additional Information for Certain US Residents
For certain US residents, including California residents, additional rights may apply regarding how we collect, use, and disclose personal information, such as the right to know, delete, and opt out of certain sharing or sale of personal information, where applicable. We do not sell personal information for targeted advertising. AI-related sharing with vendors is service provider use, not a sale. Where required by law, we will provide additional region-specific notices describing these rights and how to exercise them. You may contact us using the details in the CONTACT section if you wish to exercise these rights, and we will respond in accordance with applicable law.
Children's Privacy
Our Service is not directed to children under 16, and we do not knowingly collect Personal Information from children under 16 without appropriate parental consent where required by law. If we become aware that we have collected Personal Information from a child in violation of applicable law, we will take reasonable steps to delete such information. If you believe that a child has provided us with Personal Information, please contact us using the details in the CONTACT section.
Log Data
Like many site operators, we collect information that your browser or device sends whenever you visit or use our Service ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, device identifiers, browser type, browser version, the pages or screens of our Service that you visit, the time and date of your visit, the time spent on those pages or screens, and other diagnostic data.
Cookies
Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. We use cookies and similar technologies (such as local storage and SDKs) to collect information and improve the Service.
Like many services, we use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service. Google Analytics
We use Google Analytics or similar analytics services to collect, monitor, and analyze data about the use of our Service. This helps us understand how users interact with our Service and allows us to improve the user experience. These services may collect information such as your IP address, device identifiers, browser type, pages visited, and time spent on pages. In addition, we use Firebase Analytics (part of Google Firebase) to track app usage events, user engagement, and performance metrics. Where required by law, we will configure such services to use IP anonymization and/or obtain your consent before enabling them. Sharing of Personal Information with Third Parties
We may share Personal Information with third parties in the following circumstances: (a) with service providers who perform services on our behalf, such as hosting, database management, analytics, and customer support, and who are bound by contractual obligations to protect your information; this includes the use of Google Firebase services (including Firebase Analytics, Firestore, and Authentication) to store and manage data, including information about recipes and other content that users publish in the app, as well as related technical services (such as database management, user authentication, and usage analytics); (b) with other users, in accordance with your choices and the functionality of the Service (for example, when you post User Content); (c) to comply with legal obligations, enforce our Terms, or protect the rights, property, or safety of SmartestAppes, our users, or others; (d) in connection with a merger, acquisition, or sale of assets, in which case we will take steps to ensure that your privacy rights continue to be protected; and (e) limited Personal Information and User Content with third-party AI service providers that process such data on our behalf to generate recipes and other content. These providers are bound by contractual obligations to use the data only to provide services to us, to implement appropriate security measures, and, where applicable, to comply with international data transfer requirements (such as standard contractual clauses under EU law).
International Data Transfers
If you access the Service from outside Israel, including from the EU/EEA, UK, or US, your information may be transferred to and processed in countries that may have data protection laws different from those in your jurisdiction, including Israel, member states of the European Union, and the United States. In particular, data that you submit to the Service (such as recipes and other User Content) may be stored and processed on servers operated by Google Firebase in data centers located outside your country of residence. AI providers may also be located in the US or other countries. Where required by law, we implement appropriate safeguards to protect your Personal Information in connection with such transfers, such as standard contractual clauses or other lawful transfer mechanisms, and we require our service providers (including Google) to protect your Personal Information with appropriate technical and organizational measures.
Data Retention
We retain Personal Information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including providing the Service to you, complying with our legal obligations, resolving disputes, and enforcing our agreements, unless a longer retention period is required or permitted by law.
Security
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. We implement technical and organizational measures, consistent with guidance from the Israeli Privacy Protection Authority (PPA) and other relevant regulators, to mitigate privacy and security risks associated with our use of AI systems. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
Advertising (Google AdSense) and Cookies
Advertising. This site shows ads served by Google AdSense. Third-party vendors, including Google, use cookies to serve ads based on your prior visits to this website and other websites. Google's use of advertising cookies enables it and its partners to serve ads to you based on your visits to this site and/or other sites on the Internet.
